Judges and National Populism —The Courts Have Destroyed Democracy

In my previous article on the topic of judicial overreach and hubris I focused primarily on the effect that left-wing judicial systems were having on the ability of European governments to detain and deport illegal and criminal aliens. That piece was released on December 26^th, 2024 and since then the situation has gotten much worse than I could have imagined. Judges in the United States, France, Italy, my homeland of the United Kingdom, and across the West are now using their gavels as hammers to destroy the remnants of our Western democracies.

Our democratic states were already in a shambles. Political parties did not heed the wishes of voters and elected leaders did everything they could to further mass immigration, economic stagnation, and social decay despite running on platforms that continually promised to curtail these ills. Now, as nationalist, national-conservative, and national-populist candidates rise to the forefront promising to deliver real change—and in the case of the likes of Trump actually delivering some real change—the liberal elite have pressed the judicial system into the political fray. These judges are ignoring constitutions, established laws, precedents, and most importantly the will and right of Western peoples to decide our own futures and who leads us.

Most egregiously Marine Le Pen has been barred from running for the upcoming French presidential election, an election she was slated to win handily.

Le Pen is able to put off paying her 100,000 Euro fine and avoid jail time during the potentially years long appeals process, but her ban from public office went into immediate effect. It is transparently political. The European elite simply cannot abide major pillar of European integration deciding that it wants a different future from the decay and destitution of post-war liberalism. It does not matter how moderate Le Pen is nor how much she has stated she simply wants to reform the EU—she is a threat to liberal democracy and if France were to go the way of Orban’s Hungary it would mark the end of the neoliberal European project.

Italian Prime Minister Giorgia Meloni also continues her battle against Italy’s judges.

These liberal madmen in robes have curtailed much of Meloni’s immigration agenda and have to a great degree forced the country to keep immigration pathways open that the Italian people voted Meloni into power to close. Meloni seeks to make a ‘once-in-a-lifetime’ overhaul of the Italian judicial system so that it can no longer block her plans to redirect migrants away from Italian shores. Recent polling shows that the Italian populous backs her plans to curtail the self-accrued policymaking power of the judiciary.

And then there is the sickening case of Romania. In November of 2024 nationalist Calin Georgescu won the first round of the Romanian presidential election only for the Romanian Constitutional Court to use nebulous ‘intelligence findings’ to declare the election as null and void. In February of 2025 Georgescu was detained on his way to file to run in the new presidential election when Romanian police detained him and he was charged with the amazingly Orwellian sounding crime of “incitement to actions against the constitutional order”.

Georgescu still did manage to file his paperwork (a surprisingly orderly action) to run in the upcoming presidential election. On March 9^th the Romanian state banned him from running and instituted a 60-day ban on Georgescu making any media appearances. During all of this Georgescu had led in the opinion polls with an average of some 40% of first round voters intending to vote for him—that was until the judicial system killed Romanian democracy and left it bleeding on the floor.

Finally I get to the United States where nationwide injunctions and other universal rulings have been used to substantially hinder the agenda of the American president, Donald Trump. Despite clear Supreme Court rulings that the president sets immigration policies within extant laws—including rulings under Joe Biden’s administration—the federal courts have taken to issuing stays on the Trump administration’s ability to deport immigrants.

The courts are even now decide who can be flown into and out of the United States and when. Who needs the FAA, Department of Transportation,, or ICE when you have the American federal courts to decide every small detail of public policy? Americans and their democratic wishes certainly seem entirely unimportant to mad left-wing judges. In the case of birthright citizenship, which will now go before the US Supreme Court, lower federal judges in three separate states: Maryland, Massachusetts, and Washington State, had each issued rulings preventing the Trump ‘reinterpretations’ of birthright citizenship to going into effect across the country.

Donald Trump was elected on a promise to end birthright citizenship and move forward with the mass deportation of illegal aliens. He was elected to do this by a majority of White Americans, a majority of Hispanic Men, and a significant minority of the African American (especially male) population. The democratic mandate of the American people has been cast aside by courts who believe that their political priorities are more important than American democracy.

Nationalist leaders like Trump and Meloni must take a page from the book of Nayib Bukele and get their national judicial systems under control. If the mad ramblings, rantings, and rulings of these activist judges are not curtailed it will permanently erode Western democracies and may eventually lead to significant unrest and political chaos as people(s) realise their votes no longer matter in the face of anti-democratic judicial systems.
